AT&T has 30,000 rural land lines still regulated under old rules by Mississippi. A bill to deregulate the lines of AT&T and other phone companies is sparking a battle within the legislature.?
A bill before the Legislature would wipe out the obligations of?AT&T?and some other phone companies to serve expensive customers and would limit the Public Service Commission's remaining authority over those firms.
Skip to next paragraphPublic Service Commissioners Brandon Presley, a Democrat, and Leonard Bentz, a Republican, are fighting the move, saying customers need regulators' intervention to get their problems fixed. Other phone companies are opposed to the bill, saying it could cut the connection fees collected by small rural telephone companies.
AT&T?said remaining regulations are a burden not faced by competitors, saying some of those competitors are trying to keep rules in place to hobble the state's largest provider of traditional landline telephones.
The bill could come forward for a vote in the House Public Utilities Committee as early as Wednesday, said Chairman Jim Beckett, R-Bruce.
It would remove the commission's ability to regulate prices for about 30,000 remaining stand-alone phone lines served by?AT&T. Those lines are about equally split between homes and businesses and that many of them serve fax machines and security alarms, said Mayo Flynt,?AT&T?state president.
Several years ago, the Public Service Commission denied a rate increase requested by?AT&T?on those lines. The company said it had the power to raise rates equal to the rate of inflation without PSC approval, but the commission disagreed.?AT&T?appealed to the state Supreme Court but lost.
Presley claims?AT&T?is pushing the bill in part to retaliate against the PSC. Flynt, though, said it's time to relieve deregulated companies of burdens that date back to when they were regulated monopolies.
"The law shouldn't place certain obligations on some companies and not others," he said.
The company said it should no longer be required to make efforts to serve any customer in its territory, no matter the cost, because federal aid for such universal service is going away.
"We shouldn't have the obligation," Flynt said. "There's no funding."
Presley said?AT&T?should keep serving expensive rural customers, considering the decades of profits it's made from the state.
"I think the rural customers should have the right to have a phone line, period," Presley said.
Beckett said he's in talks with various parties and the bill could change. Dean Kurtz, a CenturyLink official, said?AT&T?has agreed to cut a provision that would have decreased the access charges received by small phone companies. CenturyLink, based in Monroe, La., serves 20,000 lines in Mississippi, mainly in and around Olive Branch.
Rick Lambert, a lawyer for the Telephone Association of the Southeast, which represents smaller phone companies, said his group is against the bill in part because it is concerned about access charges. The measure would also ban Mississippi from setting up its own universal service fund, which could help subsidize serve in rural areas, he said.
Presley and Bentz also oppose the bill because they want the PSC to keep collecting data on complaints. Presley said that the commission's authority to handle complaints is a key aid to consumers, even when the commission has little or no authority over the service.
"One of the big areas we help consumers with is cutting through red tape," Presley said.
Presley cited commission data that showed complaints against?AT&T?have risen sharply in recent years, although Flynt said AT&T's own numbers show only half as many complaints as Presley cited.
Flynt, though, says?AT&T?already addresses complaints from the commission in areas that the commission doesn't regulate, and would continue to do so. He noted that the same section of the bill would relieve?AT&Tfrom its requirement to file financial reports
"There's nothing for the PSC to do with that data," Mayo said. "It's just a burden."

Microsoft's future riding on Windows 8

SAN FRANCISCO (AP) ? Microsoft is scrambling to preserve what's left of its kingdom.
Since the company released its Windows operating system in 1985, most of the sequels have been variations on the same theme. Not that it mattered much. Regardless of the software's quality, Microsoft managed to remain at the center of the personal computing universe.
The stakes are much different as Microsoft Corp. puts the finishing touches on Windows 8 ? perhaps the most important piece of software the Redmond, Wash. company has designed since co-founder Bill Gates won the contract to build the first operating system for IBM Corp.'s personal computer in the early 1980s.
A test, or "beta", version of the revamped operating system will be unveiled Wednesday in Barcelona, nudging Windows 8 a step closer to its anticipated mass market release in September or October. The company will offer the most extensive look at Windows 8's progress since it released an early version of the system to developers five months ago.
Microsoft designed Windows 8 to help it perform a difficult balancing act. The company hopes to keep milking revenue from a PC market that appears to be past its prime, while trying to gain a stronger foothold in the more fertile field of mobile devices. It's a booming market that, so far, has been defined and dominated by Apple Inc.'s trend-setting iPhone and iPad, and Google Inc.'s ubiquitous Android software.
"Microsoft's future path is riding on Windows 8 and its success," said Gartner Inc. analyst David Cearley. "This is a chance for Microsoft to re-establish itself in a market where it's becoming increasingly irrelevant."
If Windows 8 is a hit, it could also help lift the fortunes of struggling PC makers, including Hewlett-Packard Co. and Dell Inc. Besides giving businesses and consumers a reason to consider new PC purchases, Windows 8 is expected to spawn a new breed of hybrid machines that will be part computer tablet, part laptop computer.
If Windows 8 is a flop, however, it will increase the pressure on Microsoft CEO Steve Ballmer. His 12-year reign has been marred by the company's troubles adapting to an Internet-driven upheaval. As Microsoft has stumbled, faster-innovating companies such as Apple and Google have elbowed their way into a position to steer the direction of computing for the next decade or two.
Ballmer, known for his zealous faith in Microsoft, hails Windows 8 as the catalyst for an exciting ? and lucrative ? new era at the 37-year-old software maker.
Investors seem to be believers, too. Microsoft's stock has recently been trading its highest levels since April 2008, closing at $31.35 on Monday. The stock has gained about 21 percent so far this year. By comparison, Apple's stock has surged 30 percent during the same period, while Google's shares have dropped 6 percent.
Microsoft's financial performance traditionally improves when it releases a new version of Windows. The last upgrade came in October 2009 when Windows 7 hit the market. The company has sold more than 525 million copies of Windows 7 since then. Part of Window 7's success stemmed from pent-up demand; the previous version, Vista, was so clunky and buggy that many PC users stuck with the system they already had on their machines or switched to Apple's technology on Mac computers.
Windows 8 is radically different from its predecessors. The system won't even have Microsoft's familiar "Start" menu. All applications are spread across a mosaic of tiles, as part of a design Microsoft calls "Metro." The tiles, which resemble road signs, can be navigated with a swipe of the finger on the display screen or with a keyboard and a computer mouse. The tiles also provide a glimpse at the activity occurring in applications connected to the Web, such as email.
The system also is expected to enable users to easily back up their pictures, movies, music and other files on a Microsoft storage service called SkyDrive, which will compete against Apple's iCloud.
The operating system's versatility means it can be used to power computer tablets, as well as traditional PCs.
Microsoft badly wants a piece of the tablet market that has been cutting into PC sales since Apple introduced the iPad two years ago.
In the quarter that included the holiday shopping season, Apple shipped 15.4 million iPads, more than doubling the volume from the same time in the previous year. Meanwhile, worldwide personal computer sales dipped slightly, and Microsoft's revenue in its Windows division declined 6 percent. It marked the fourth time in the past five quarters that Microsoft's Windows revenue has fallen from the previous year.
Reversing or slowing that trend is critical for Microsoft. It still relies on the PC industry for about 55 percent of its revenue, according to Nomura Equity Research analyst Rick Sherlund. "The launch of Windows 8 should provide a few years of robust growth and opportunity for Microsoft to reposition itself to better defend its position against challengers," Sherlund wrote in a note after Microsoft reported the latest erosion in its Windows division.
Besides spurring more sales of the new operating system, Windows 8 is likely to drive demand for the next generation of the Office suite, another major moneymaker for Microsoft.
Windows 8 could inspire more PC makers to design machines that combine the convenience of computer tablets with the utility of a notebook computer. These devices would be similar to the so-called "Ultrabook" computers that offer a Windows-based version of Apple's lightweight MacBook "Air" machines. Once Windows 8 is available, the Ultrabook line could be expanded to include machines equipped with screen that swivels off the keyboard to take advantage of the system's touch controls and provide a tablet-like experience.
Microsoft clearly envisions Windows 8 becoming the foundation for pure tablets, too. That's why it's developing a version of Windows 8 that can run on the more tablet-friendly microprocessor technology licensed by ARM Holdings. That version will complement the Windows 8 design that will run on the Intel Corp. chips that power most PCs.
HP, the world's largest PC maker, is already counting on Windows 8 to deliver better times. The company's division that includes desktop and laptop computers suffered a 15 percent drop in revenue during its more recent quarter ending in January. CEO Meg Whitman, last week, said HP expects to release PCs and tablets running on Windows 8 in time for the holiday shopping season. HP's Windows 8 product line will include a tablet designed for corporate customers.
The biggest question hanging over Windows 8 is whether the long wait for the software will leave Microsoft hopelessly behind Apple and Google in mobile computing.
Whatever headlines Microsoft grabs during Wednesday's preview are likely to be quickly overshadowed when Apple shows off the iPad 3 ? a hotly anticipated event, expected to occur in early March.
Meanwhile, Google says more than 300 million smartphones and tablets are already running on its Android software, with another 850,000 devices getting activated each day. At that rate, another 155 million to 180 million devices could be running on Android by the time Windows 8 comes out in September or October. As it is, a version of Android is already running the second hottest-selling tablet, Amazon.com Inc.'s Kindle Fire.
"Microsoft is late to the game and this is a different game than they have been playing," Cearley said. "But if they hit a home run with Windows 8, it could still turn some things around."

Hands-on with the HTC One S
The HTC One S (Codename: Ville) might not be the "flagship" device in the manufacturer's new lineup, but don't thell that to the phone. It's a little smaller than the One X, at 4.3 inches instead of 4.7 inches. And it's traded the 4.7-inch Super LCD 2 for a 4.3-inch AMOLED display and Gorilla Glass. It also loses a tad in the way of resolution, dropping to qHD instead of full 720p. And it trades the polycarbonate shell for an aircraft-grade aluminum that's been fried in plasma in a process that's called microarc oxidation. In layman's terms, it basically turns the metal into a ceramic, and it feels quite nice.
The HTC One S has the same camera technology as the One X, as well as Beats audio. It's crowning achievement, probably, is that it's crammed into a body that's just 7.9mm thin. You have to feel it to believe it. But that does come with a trade-off: The non-removable battery is just 1650 mAh.
Other specs of note: It's rocking a dual-core Qualcomm Snapdragon processor at 1.5GHz, has 1GB of RAM and 16GB of storage, plus the 25 GB you get with HTC's new deal with Dropbox.
Rogers and Fido have announced they're carrying the HTC One S, as has T-Mobile in the U.S.

WASHINGTON (AP) ? The top U.S. diplomat in Kabul and a campaign adviser to President Barack Obama said Sunday the U.S. isn't rethinking its commitment to Afghanistan after violent protests left more than two dozen people dead, including two American shot inside a government ministry.
U.S. Ambassador Ryan Crocker and Robert Gibbs, Obama's former press secretary, said they believe Afghan President Hamid Karzai's fragile government could collapse and the Taliban would regain power if the U.S. were to walk away.
"This is not the time to decide that we're done here," said Crocker. "We have got to redouble our efforts. We've got to create a situation in which al-Qaida is not coming back."
Added Gibbs: "What the president's trying to do now is get us to a point where we can hand off the security of Afghanistan to the Afghans and that we can bring our troops home."
Their comments echoed arguments made by the Bush administration at the height of violence in Iraq, even as popular support for that war was waning. As in Iraq, American voters are questioning the utility of the decade-long Afghan conflict and whether a stable government there would be worth the loss in U.S. blood and treasure.
"If we decide we're tired of it, al-Qaida and the Taliban certainly aren't," said Crocker, who served in the Bush administration as ambassador to Iraq.
Obama apologized last week to Karzai for what U.S. officials said was an inadvertent burning of Afghan religious materials, including Qurans, at Bagram air base north of Kabul. Still, the incident fanned anti-Western sentiment across the country, leaving dozens of people dead, including four U.S. troops reportedly killed by their Afghan counterparts.
On Saturday, a U.S. lieutenant colonel and a major were found shot inside a heavily guarded Afghan ministry. The Taliban claimed responsibility and said the killings were in retaliation for the Quran burnings. The shootings prompted the unprecedented recall of NATO personnel working inside Afghan ministries, dealing a serious blow to the U.S. effort to rebuild the Afghan government through mentoring.
Afghan officials, including the defense and interior ministers, canceled planned visits to Washington this coming week so they could remain in Kabul for consultations about how to quell the violence, Pentagon press secretary George Little said Sunday. He said Defense Secretary Leon Panetta "understands why that's a priority" and hopes to see them soon at the Pentagon.
Meetings with Panetta and Joint Chiefs of Staff chairman Gen. Martin Dempsey were on the schedule.
Obama's political opponents have seized on the series of events to cast doubt on the president's handling of the war, aligning themselves with voters frustrated by the slow progress.
GOP presidential candidate Newt Gingrich said that if Karzai "doesn't feel like apologizing then we should say good bye and good luck, we don't need to be here risking our lives and wasting our money on somebody who doesn't care."
Republican hopeful Mitt Romney said he supports a continued U.S. military presence in Afghanistan, but said the recent shootings were proof that efforts to rebuild Afghanistan weren't going well.
"It's an extraordinary admission of failure for us to establish the relationships that you'd have to have for a successful transition to the Afghan military and Afghan security leadership," Romney said.
Crocker defended Kabul's reaction to the protests and said Afghan security forces are working to quell the protests.
"They've done so with loss of life on their side as well as some of the protesters, and they have been defending U.S. installations," Crocker said. "So they are very much in this fight trying to protect us."
Sen. John McCain, the top Republican on the Senate Armed Services Committee, said he agrees with Crocker that the U.S. can't leave yet. In fact, he said Obama should replace his timeline to withdraw troops with a longer-term agreement with Kabul to keep the country on track.
"Have no doubt, that if Afghanistan reverts to a chaotic situation, you will see al-Qaida come back and it again (will) be a base eventually of attacks on the United States of America," he said.
At a NATO summit meeting in May in Chicago, the alliance and Karzai intend to determine a path for handing over full security responsibility to the Afghan government by the end of 2014.
Crocker, Gibbs and McCain spoke on CNN's "State of the Union." Romney was on "Fox News Sunday."

NGOs 'behind' India nuclear delay
The Indian prime minister has blamed US non-governmental organisations for the delay in commissioning the Koodankulam nuclear plant in Tamil Nadu state.
Manmohan Singh told the prestigious Science journal that these groups did not appreciate India's growing energy requirements.
The plant has been stalled by protests from local people over safety concerns.
Mr Singh also blamed US and Scandinavian groups for opposing genetically modified crops in India.
Critics say Mr Singh's comments hark back to the pre-liberalisation days when Indian politicians blamed all of India's problems on foreign countries.
"You know what's happening in Koodankulam," Mr Singh said, referring to months of protests which have stalled the commissioning of two 1,000-MW nuclear reactors at the plant in Tirunalveli district.
"The atomic energy programme has gone into difficulties because these NGOs [non-governmental organisations], mostly I think based in the United States, don't appreciate the need for our country to increase the energy supply."
Referring to a 2010 government decision to defer the commercial cultivation of the genetically modified vegetable BT brinjal, Mr Singh said biotechnology had enormous potential and India must make use of it to increase agricultural produce.
"But there are controversies. There are NGOs, often funded from the United States and the Scandinavian countries, which are not fully appreciative of the development challenges that our country faces.
"But we are a democracy, we are not like China," he said.

Gabe Watson, Alleged Honeymoon Killer: Acquitted of Murder!
Gabe Watson, the accused and so-called Honeymoon Killer, who spent 18 months in an Australian jail for manslaughter, was acquitted today in an American court.
Watson has been cleared in the 2003 death of wife Tina, who died on their honeymoon, suspiciously, and not even two weeks after the couple got married.
Prosecutors in Birmingham, Ala., alleged that Watson, 34, shut off his 26-year-old wife's oxygen supply while scuba diving in Australia to collect insurance money.
But, when the prosecution rested after two weeks, the judge granted a defense's motion for an acquittal on the grounds the prosecution failed to prove its case.
"The evidence is sorely lacking that it was an intentional act," Judge Tommy Nail told the courtroom, according to The Birmingham News.
"The only way to convict him of intentional murder is to speculate. Nobody knows exactly what happened in the water. I'm sure we'll never know."
Watson's mother collapsed in tears outside court.
Watson was being tried in Alabama because that's where he had been married and where the alleged murder plan had allegedly been hatched.
He stunned members of Tina's family when he pleaded guilty in Australia in 2009 to a lesser charge of manslaughter.
Australian authorities agreed to release him to the United States to face charges here after American authorities waived seeking the death penalty.
In 2008, while still facing murder charges in Australia, Watson married Kim Lewis, with whom he had gone to high school.
